Hi,
i had applied for student visa back in 2008 for diploma and it was refused in december 2008 afterwards i appeal against this decision and now in Sep 2009 my appeal got successfull. Hence it was noteable period and my preference changed due to change in market and now i want to change my Diploma with Master Degree with same appeal. my question is this would be safe for me or there would me any issue in this by embacy.

My brother visited me and my family in october 2007. He made another visit to the UK in January 2008; in this second entry, the immigration officer that allowed him entry did not stamp his passport. I phone the Immigration at the airport to inform them about this but they advised me that I need not to worry as the can trace his entry via his landing card. He returned back to Nigeria in march 2008 before his visa expired.
In july 2008, he applied to visit the UK again for business reasons; his application was refused on the ground that he did not include evidence of his second visit to the UK (like boarding pass and confirmed flight ticket)as they did not believe that an entry clearance officer can forget to stamp someone in.
He enclosed these documents and applied again, but the embassy in nigeria refused his application again stating that they did not believe that he his genuinely seeking entry in the UK for less that 6 months.
I want to invite him again to the UK as my wife has recently have a baby and we want him to be the baby’s Godfather at the christening.
Do you think that his previous refusals would affect his application this time?

I cannot answer the question of whether or not you/your relative will get a refund, as this will depend on their refund policy. As a general rule, an educational provider should not charge the whole course fee without offering a refund if a visa is not obtained. You need to talk to the college. You could also speak to their accreditation body e.g. ASIC or BACS.
Your relative is free to apply to another college but make sure it is on the Tier 4 Sponsors Register.

my relative applied as a student from another college in the UK and i paid the whole course fee since november 2008 but the college did not lodge her application at all until the tier 4 came on effect.now i just found out that the college is not yet in the register of sponsors still awaiting accreditation,is it possible to get my money back and apply her to majestic college…waiting for your advice..thank you.

You should take advice on this. If they accepted your documents before Tier 4 was implemented on 31 March, they should process your student visa under the old rules. At very least they should have told you what was going on with your case. On the other hand, it may be to your advantage to apply under Tier 4. Which is why you should take proper legal advice.

I’ve been apply my student application last March 28,2009..Until now there is no schedule for the appointment for the NVQ students for their visa processing agent…I went to visa processing agent to ask what will I do because up to now there is no schedule for appointment for the NVQ…They told me that I’m going to apply for the Tier 4.What are the best things to do regarding this matter..Please help me..Thanks.

Schedule for what? The British Embassy or their visa processing agent? You could try chasing them. Larger emabssies, such as Manila, are very busy and it can take several months to obtain a student visa. See NVQ student visa situation improves since British Ambassador apology

An adviser cannot advise on a refusal he/she have not seen, but for the majority of the 'usual' refusals it is worth an appeal (www.visaappeals.com). Unless you have submitted false documents, lied or have a poor immigration history there is no reason why you should not successfully reapply, but should put forward a good professional application, which addresses the previous refusal. www.immigrationmatters.co.uk
