New Tier 4 student forms for use after 31 March 2009

The UK Border Agency has today published the “Tier 4 (student) application forms, to be used for applications made on or after the 31 March 2009″.

The forms can be used for all types of applications made on and after 31 March 2009, including those in person at the public enquiry office.

Applications currently in the system should be considered under the current rules, not Tier 4.

Refused Visa (VAF) Applications

If you are refused entry clearance under the current rules you have the ‘right of appeal’ to the AIT (Asylum and Immigration Tribunal), where your case will be heard before an independent Immigration Judge in the UK.

Appeal specialists Bison UK has successfully overturned over 95% of visa and other refusals on appeal.

Applications made under Tier 4 – after 31 March – will not carry the right of appeal. Refusals will instead be dealt with by an Entry Clearance Manager (ECM) under a controversial new internal review system.

You can apply for a visa extension or further leave to remain (FLR) at the Home Office/UK Border Agency. You could also take advise from an OISC regsitered immigration adviser.

You should follow the instructions. Depending on where you are applying, there will normally be a visa handling agent (e.g. VFS Global) attached to the British Embassy posting which deals with the paper based documents.

If you do not have an application in with the Home Office you need to take advice urgently from a registered Immigration Adviser

i just finish my NVQ 3 now I have enrolled for NVQ 4 but there is a 3 months gap before I enrolled due to no schedule of classes yet, would it be a big issue on my visa? please help

vfs uk visa already told me that my visa application is already forwarded to the british high commision on the time i submitted to visa application centre, my problem now is that im worried enough because my vis ais already expired last 2 days march 26, 2009 and i still dont have my papers with me.please help me.thank you and godbless..

hi mr kelly. i just want to ask u some questions regarding the new rule in the Home Office. im holding a student visa and my visa is nearly expired in 2 months time. i just done my NVQ level 3 but im still registered to the college where i did my course but i am planning to change college to do my NVQ Level 4.can u please give me some advices what to do and can u pease tell me what are the requirements for applying a student extention visa and how much it will costs plz plz plzzzz….

i got a visa refusal letter this week and my deadline is 6-4-2009.(for appeal)
1. am a postgraduate student, finishing my studies in september. i have been in unversity from last year february
2. i intend to go back to my home country after my graduation this year.
3. the reason fo the refusal was,inssuffici funds.their argument is that there is no evidence of trasfers into THE UK ACCOUNT. But if i am able to access the account through the ATM, and evidence is there on the foreign statement,~(and they did not mention this fact in the refusal), do i have to transfer funds, or accessing them from the UK is enough?

I just would like to ask if there would be a possibility to have an extension after my 2 yrs contract from my employer as my visa expires as well in 2 years time. Is there a possibility that home office will extend my visa or it depends on my employer. thanks and more power!

my son was able to successfully lodge his online application for student visa early part of march unfortunately he had difficulty in getting an appointment to the embassy but he finally did had on the 1st of april and was scheduled to report on the 6th of april.But at the embassy he was advised to use the new form under the PBS. when he insisted his application came before the deadline he was given an unthought response that he should have walked in to submit his documents before the deadline??? how would the poor boy know what to do when everytime they make a phone call they are always told to do it online or at times its a recorded message that anwers the call but theres nothing there in the website or wherever that tell that they could walk-in! Please give us the the best or next step to do. thanks.

It depends on a number of factors and what type of visa you are holding. Suggest you take advice from an OISC registered Immigration Adviser.

Sorry to hear that. Not sure which Embassy you are referring to, but they have and VFS Global not been very helpful? You may wish to challenge this as you have submitted an online VAF, or just apply under Tier 4. Immigration Matters did advise student visa applicants to deal with this issue by walking in or submitting docs by registered mail some weeks ago. See:

I will like to have some clarifications on the new Tier 4 system.General students (Adult Student) are required to show in a personal account that they have held tuition fees and maintenance funds for atleast 28 days and that the end of 28 days should not be more than one month before the visa application. Now my concerns are;

*Apart from this account in the student’s name, does the student need to prove where the money is coming from? or only this personal account suffices with justifications like the bank statement of the account and the attestation from the bank.

*If the money is coming from a parent or relative, does the student need to add their documents in the visa application, like employment details, payslips, source of income etc?

I have already bookedmy appointment for the 14th so i need this information as soon as possible.

You should take advice on this – see an immigration adviser. Visa extensions are affected by a number of factors including ’satisfactory academic progress.

i applied for student visa extention on 26th of march 2009 while my visa was expiring on 31st march 2009. my course was postgraduate level PGC in business administration and course started at january 2009 and finished date is july 2009. i have got my visa ID card today on 24th of jume and its issue date is 18th june 2009 and it is valid untill 7th july 2009. in short i am given visa extention just for 19 days. while i have already registered for MBA and fee is fully paid. so i have to reapply for extention within week again. does 28 day funds rule apply on my case since i have not required ammount in my account for last 28 days before i apply….?????

I have applied for uk study visa first time in sep 2008 for post gratuate studies in middlesex university london,i got refusal because the date on my offer letter got expired during processing,they also not give me right of appeal.so i again apply for jan 2009 with the same university paid 4000pound fee(also paid in first case)got again refusal again for unmached course and not sufficient funds in my account but actually i got 13000 euro and 30 lack pak rupees statment of my sponsor.this time i got right of appeal so my appeal lodged in 9 december 2008 now my second update date passed which is 19th of june i am sure to win the appeal but unable to avail september session,so my question is can i reaplly with the new point based system i ahve enoough funds in my account got ielts 6.5,
is my last two refusal and my running appeal afft my application kindly advice me

I was wondering if someone can help me with my issue.
I have sent off my documents to home office on the 23rd of April 2009, and only on the 16th of June I recieved a letter to make a biometric appointment. I have done my biometric appointment on the 19th of June, and now its been almost 2 weeks and I have not had any news. any idea how long it might take? and what are the chances to have a positive answer?

my college has just been removed from HO register.when i applied for extension in feb it was given license.as at june 3 009,it was still on the register.as of today,it is no longer there.i contacted the school authorites for refund bu no assurances given.i have tried applying to other accredited colleges,bu all want my passport before admission.please what do i do?

You should see an immigration adviser as soon as possible to get this sorted out (see OISC). You did not say whether or not you had heard back from the Home Office or what the state of play is with your application. You applied in good faith at a time when the college was on the Tier 4 Sponsors Register, so this is not your fault.

I finished my postgraduate diploma and applied for tier1 ~PSW on 30th march2009 and unfortunately my application came back saying that its invalid as my transaction fee that i have to pay for the application was declined due to some security reasons.My visa is about to expire in august 2009.can u please suggest me what to do to get my visa extended to workpermit.Will there be any agencies who can provide tier2 or any other workpermit for my qualification.

dear sir ,

i had submited my tier 4 student visa file on 17/07/09 . my file got refused due to my silly mistake in writing sponser license no. in application form . bcoz
On the visa application form there weren’t enough boxes to write in the whole number, So I have put a lesser digit in there which has created the confusion.(The sponsor license number has been double verified with THE ACADEMY, and it has been claimed as the license no. on the letter head is correct.

i had already fillup administrative riview form and it has alrady 20 days passed but still i didnt get any reply and my admision date is 7th sep. plz help me and give me some answer about it . husen_saiyed2001@live.com plz mail me …

You should chase the embassy or ask the university to help you. The review could take several weeks.
You could also submit a new application if you cannot wait.
Tier 4 applications are not as easy as they look and people would be advised to seek professional advice when applying for a student visa.

I got my student visa refusal and as i had applied after my visa got expired, there is no right to appeal also.The reason for refusal was that i didnt enrol for the college of which the documents i had submitted.So i need your suggestion that should i go back to india and apply again??and will it be easy for me?or are there any chances of staying here and reapplying in any other tier?

Urgent assistance required!im extremely tense.

I applied for a student visa about a week ago and i have a enquiry and i urge you to please clear it..Well the thing is that i have submitted all my documents with my application form all my documents i given were original, however there is a problem and that is i have made a few minor mistakes in filling out my point based appendix application form and i realised it after submitting my application, i have made mistake by forgetting to put crosses in a few places first i didnt put a cross which ask you to confirm that i have provided the original visa letter from the sponser however my visa letter is 100% original and anybody can say its original by taking a look at it more than that i have provided all the original academic transcrips and certificates listed in the visa letter.second mistake i didnt put a cross where it says have you been assesd by the sponser on the basis of artwork i have omitted it also but its clear in my visa letter that sponser havent assesd via this means,so i want to know that can even minor omissions on the application can reject your visa despite all documents being right.??so please tell me that if i have submitted all the right documents but have made some omissions in the pbs application form can this reject my student visa?..I think it will be much better if they call me to clear such issues rather than to reject my application straightforeward.

Please give your honest opinions.

I’m from Canada and I submitted my Tier 4 General Student visa application yesterday through a visa application centre in Canada. The thing is that I submitted my visa application after my course state date stated on my visa letter.
Does the High British Council still grant visas for application submitted after the course start date?

Dear Charles
my tier 4 application has just been refused on the grounds that although i had sufficient funds…the bank statements i provided did not show my name..they did however show my bank details and had been stamped at the bank to show they were genuine.
i have not been given a right of appeal but suggested a fresh application. what is the best course of action?
get new statements with my name and cross reference with the name less ones to show that they still refer to same account…?
please help

Please advise me on my case,i applied for student visa in saudi arabia last september 2008 and was refused for 3 grounds,i made an appeal and it was approved last august 2009,last november 2009 the british embassy told me that my visa will be stamp unless my school start date will be updated since they found out that my acceptance letter is out of date,unfortunately the school that i enrolled with have thier licensee suspended for Tier4 last september 2009 and until now there name does not appear in the UKBA registry of sponsors.Now,i have inquired to my school and i managed to have an updated school acceptance letter from them but at the moment i am afraid to pass my school acceptance letter to the british embassy here in KSA because they might refuse me due to my school is not on the UKBA registry?The school that i enrolled with told me that i am not covered by TIER4 before i lodge my student application last year.is that true?..

I am a tier 4 applicant in the pHilippines.I had stuedent visa before under the old system.I just passed my application at VFS last dec 4.But I was denied because the ECO didnt award 10 points to my maintenance.It states that i wasnt able hold the funds for the required period.I am using my UK bank account which was opened way back 2008 and is still present and active. I submitted detailed bank statements. the last statement i submitted was dated Nov 18. How come i was awarded 0 point for this?Could you enlighten me? Thanks

I have a friend who has just been refused their visa extension and they have appealed against the decision, but before that their college was black listed they are now applying for other colleges and no colleges will give them addmission until they have their visa extension. Will this affect their appeal, will it be successful and can they give them chance if they have they visa to get addmission?

I ve sent my application for PSW last week, but I do not remember if I ticked the box regarding my university being “recognised body”.
But I do have an evidence that it is (letter from university).

It is very worrisome that after I have showed enough evidence at the embasy of my maintenace fund ,they scored me 0 points for maintenace fund, the entry clearance manager said I did not provide enough evidence that my sponsor is truly my father after I have produced affidavit of relationship with his passport photograph attached and an introduction letter from him, also the bank statement reveals that he has deposited the money in my account in his name.The exuse I was given is that I did affidavit of relationship the very day my application was filled in.My question is that is there any rule that kick against that?Although my father has been away on a biz trip and had to come because of my application which was a night before my application was filled in.
Although I have filled in an administrative review to that effect,I just want an advice from you.

I got my visa refused on the grounds of maintainance cost which i availed from a bank loan. But uk embassy rejected my visa as the loan amount was disbursed before filing up the application, and because of that I was denied applying for further submission until ten years from now. But it is also said in the refusal letter that i can submmit a fresh application.

Can i apply agian a fresh application after this refusal? Please reply….

Hi Kelly, my visa finish on 31/12/11 Sunday but my ielts result may take time to release. Bank statement will be ready on 1/1/12 I am worried, what should I do?
