An increasing number of overseas students are running into difficulty renewing their student visas where the educational provider is not listed on the Tier 4 Register of sponsoring colleges, according to Immigration Adviser Evelie Padadac.
Since Tier 4 of the Points based System was implemented on 31 March this year, colleges must be licensed by the UK Border Agency (UKBA) to take international students on student visas.
In country students already in the system do not come to light until they want to extend their visas.
The new 56 page ‘TIER 4 (G)’ form (APPLICATION FOR A GRANT OF LEAVE AND BIOMETRIC IMMIGRATION DOCUMENT UNDER TIER 4 GENERAL STUDENT), which replaces the FLR form, clearly requests the ‘Sponsor Licence Number’ in section 3.
Evelie, an OISC registered adviser with Bison UK, has advised several students this week whose visas are expiring but are studying at colleges not yet licensed by the UKBA.
Some have even been told by the non-registered college that their “applications have been sent to the Home Office”, which leaves the students in a very dangerous position since the application, in the unlikely event that it had been submitted, would be rejected.
Evelie was worried that they could be left stranded if their visas expired. She said:
“The students are being kept in the dark by the college, which has applied for the sponsor licence, whilst the clock is ticking on their visas.
“If their visa expires they will have to leave the UK and could be branded an ‘overstayer’.
“Others have had their applications returned by the UKBA advising them to “register with a licensed college”.
You can check the Sponsors Register on the ‘Sponsoring students under the points-based system for immigration‘ of the UKBA website.
Colleges appearing on the register will be given a Tier 4 ‘A’ or Tier 4 ‘B’ rating based on a scoring system, but the main point is that they must be listed.
Colleges not yet listed may be one of the hundreds of educational institutions still be going through the accreditation process with one of the accreditation bodies such the British Council, BAC or ASIC.
ASIC publishes a directory of colleges accredited or currently going through the process.
Once a college is accredited it can apply for a Tier 4 licence, which will take around six weeks and involve an inspection visit by a UK Border Agency officer.
Cynthia Barker, Centre Manager of Majestic College, which has received its Tier 4 Licence, said the whole accreditation and licensing process could take up to nine months.

You need to ask the your college why it is no longer on the tier 4 sponsors register or speak to the UK Border Agency. You could also try the accreditation body which accredited the college – e.g. ASIC, BAC or the British Council.

To answer your question, it is unlikely you will be sent home “right away”, however, you should transfer to a REGISTERED provider, even if your visa was issued prior to the Tier 4 rules. I have a number of concerns here:
Why does your employer want you to transfer to this training provider? You are the student and you are responsible for complying with your visa - your student visa has nothing to do with you employer and you are not tied to an employer.
Why is your employer recommending this a non-registered company? Clearly, you should only be transferring to a Tier 4 UK Border Agency Registered Sponsoring college, not one that is ‘not yet’ on the UK Border Sponsors register or ‘in the process’ of registering. How can you be sure they will be accepted as sponsors by the UKBA or how long it would take? Do you want to take the risk?

An NVQ training provider giving training to employers for UK resident staff (e.g. Train to Gain funded NVQ’s) may be a perfectly good NVQ training organisation, but not geared up or registered to take international students.

“Many well meaning employers are totally misguided in this and other immigration areas on student visas and work permits. It is the visa holder’s responsibility to comply with the rules on student visas, and at the end of the day it is the student, not the employer (or relative) who suffers when their visa is cancelled or not renewed because they took advice from a non-professional.
“If you, the student visa holder, do not obey the immigration rules on student visas (and or Tier 4) you risk being sent home and being banned from returning to the UK for up to 10 years under immigration rule HC321.”
My advice is simple: find a registered college which provides the right NVQ course for you. That way you are safer.

There are a number of colleges which have not received sponsorship that in order to keep financially afloat fraudelently put pressure upon its existing students to pay money. The courses, as they haven’t received sponsorship, are usually worthless.Get out now!

You said you sent your passport “before your college was in tier 4″. Are they now registered or about to be registered? If so, you should be covered.

I am among one of the students who have been deceived by a college who once was accredited and now has lost its license and it is not a Tier 4 sponsor anymore. I paid the full fee for a MBA but after I finished my course they say the have no partnership with any University so all I can get is a PG Dip with them. The fee for a PG Dip course was at time of registration £1000 less than what they charged for MBA.
Is there any way where I can get a partial or a full refund? I am now applying for an extension with an accredited college and unfortunatelly the course I will be doing is going to be the same one I had studied once before.
You could pursue a claim through the County Courts, or complain to their awarding body and accreditation bodies such as BAC or ASIC.

You should talk to the college and find out what the problem is with their licence, as this will affect your application. You could ask for a refund of your fees if the college is no longer able to take overseas students.

As long as the college is on the UK Border Agency they can recruit overseas students on student visas. You could ask why they have a B Rating, which may be because the UKBA require them to make improvements.

You need to find out why they are no longer on the Tier 4 Sponsors Register. It could be a temporary measure until the college meets the UK Border Agency’s standards. You could also try contacting the UKBA area monitoring unit.

What really happens to institutions which lose their licences within one month or a few days after being registered for Tier 4?
And why would UKBA issue them licences in the first place when it is not sure that those institutions can keep their standered even for a few days… It’s really funny…
And then who is responsible and who will refund the money of students who lose thousands of pounds when their visa are being rejected by home office bec the colleges lost their licences within a month of registration with UKBA for Tier 4?

I applied for a post study visa on 19th March, 2009 having completed a post grad diploma, within the old rules before Tier 4 came into effect. My college had been under dfes and was then visited by BAC and received accreditation by the time i submitted my application. I got a refusal letter from UKBA claiming that my college was not appearing as a listed college under DFIUS. By the time i sent my application my college was not under TIER 4 but is now in the sponsor list from August, 24. My question is can i question the UKBA as to why they did not offer a post study visa to me when the college was already accredited by BAC, as per mid March. P/s advice. I still have valid LTR.

My current student visa expires on 31 august, and I need a 3 month extension to complete the course. My college, SAE Institute had been registered under dfes, but is only due to receive a decision on accreditation from BAC today (and then they have to apply for a tier 4 licence. is it worth me making an application now, in the hope that I will be entitled to appeal the refusal, and that by then, SAE might have obtained its tier 4 licence? Or do I need to go home before my visa expires, and apply for a new visa in a few months time when hopefully they will have a licence?

Based on experience in dealing with this for Majestic College, if the college is only due to receive it’s BAC accreditation today (assuming it gets it today) it could be another 6 to 8 weeks before the are licenced by the UK Border Agency and appear on the Tier 4 Sponsors Register.
They still have to apply to the UK Border Agency who now appear to be inspecting all new colleges before granting a licence to sponsor overseas students.
You should urgently talk to an immigration adviser. See the OISC website for a list of advisers in your area.

If your college is off the UK Border Agency Sponsors Register your visa will probably be refused. You could also be refused entry if you obtain a visa for a college which is later suspended.
Hello. got a problem with my school. last month of august I emailed to them asking for a permission to transfer to other care home due to health reason. because I live in a countryside & the hosptal will take an hour drive by bus (No bus on sundays actually). Yesterday I received a letter its an Invoice asking me to pay £500 for recommencement fee? whats that? I have never heard of this fee. You could talk to the college and ask them? The college should not be too concerned if you move to another employer as long as it is in line with your course.

Im bit confused of what contract i am going to follow, my school or my employer? Does the school have any hold with the student if one decides to transfer to another college or move to other employer? am i in a breach of contract with the school?
What does your contract say? Most educational establishments do not tie a student to an employer, and no employer can force you to work there.
the contract says that i am not allowed to transfer to other care home without their permission. and with that im in breach of contract they said. In my case i informed the school but they still insisted that I should not resign or else i will fine a fee of £5oo.

There are plenty of alternative colleges listed on the Tier 4 Sponsors Register (see link at: http://www.immigrationmatters.co.uk/wp-admin/post.php?action=edit&post=1644).
If they are still awaiting a BAC accreditation inspection, which will be followed by an apllication to, and inspection by, the UK Border Agency, they are most likely many months away from obtaining a Tier 4 licence.
You should take advice from a Solicitor or Citizens Advice (CAB), as it may be considered an unfair or unenforceable contract.
Companies are not allowed to “fine” you. See story regarding the banks penalties on overdraft charges.

You should direct the question to the college and ask them if they will return your money. What did you sign? is the deposit refundable????. If not see a Solicitor or Citizens Advice.

A college does not have to be registered on ASIC (one of the accreditation bodies) to be listed on the UK Border Tier 4 Sponsors Register. Check the UKBA register.

What really happens to institutions which lose their licences within one month or a few days after being registered for Tier 4?
And why would UKBA issue them licences in the first place when it is not sure that those institutions can keep their standered even for a few days… It’s really funny…
And then who is responsible and who will refund the money of students who lose thousands of pounds when their visa are being rejected by home office bec the colleges lost their licences within a month of registration with UKBA for Tier 4?

Hi! I would like to ask if our school NVQ Training Group is listed in UKBA sponsorship. We haven’t found it but our agency insisted that they authentic school. We already asked the assistance of CAB.They also told us it is bogus.We told our agency about it and the NVQ training group told us that they are still on going process. Hi Charles! I’m on a student visa here in the UK, my visa expired last January 2009 and until now I’m still waiting for the result of my visa extension. I’ve done and submitted all the papers that they require. I’m just wondering why is it taking them too long to process my visa extension. I’ve been waiting nearly a year now. At that time my college was in the process of getting a licence and they got the licence in september 09. my application remained in the ukba until nov 11th and now i got a refusal reason being college not bona fide. Also the college made me change my course coz the awarding body used to be an american university and according to the new rules the college had to change to ABE. Now am enrolled in a diploma level and they refuse my visa saying i am now in a lower level course..Can u please advise me if i can appeal for this refusal , thanks

My student visa expired on 30th June 2009. In the month of May 2009, I took admission in ***College which was on tier 4 register. They issued me visa letter to accompany my appplication. Somewhere in July 2009, home office or UKBA(whatever), removed this college from the tier 4 register.
The college office used to assure the students not to worry about anything as the college would be back on the tier 4 register. This went on till september end and I got my visa refusal stating that on 24th september 2009 my **** college is not on list of approved sponsors.
When I applied for visa this college was on tier 4 register. What the hell I am supposed to know about what goes on between the college and government?
I was told that I will receive communication from the border agency to change my college within 60 days and re apply for visa. This did not happen.
Now I am in appeal. Please let me know on urgent basis what will happen in such case?
Ther is one more part in my refusal letter, which makes the case more complicated. I had earlier applied for PSW visa through ******* college and was refused PSW visa due to submission of fictitious documents. Because I had extant leave to remain in UK till 30th June 2009, I took admission in **** college to extend student visa.
The refusal letter carries both the remarks.Firstly to use deception with ****** papers and secondly ****college not on list. I never had any funds problems.
Now what happens in such cases at AIT? I need urgent advice.
Ofcourse I will say that I was a genuine student studying at ****** college. Also I am genuine student of **** college At the court room.
But if a student is refused visa after his college is removed during waiting period, then what is the past results of such appeals?
Please give me urgent advice.

i am currently studying at London based college , which is registered college on home office tier 4 sponsor scheme, however its been so long that i have submitted my application for an extension to stay in united kingdom and haven’t heard anything from them. i have phoned them many times the only answer i get is application still under process. would you kindly be able to tell me why they have kept my application for such a longer period of time yet there isn’t anything wrong with my college and my application.
More over in regards to work and other, i have worked less then 20 hours through out my term time i have provided them proof. i also submitted my sponsorship along with my application stating who is responsible for my expenses during my education. now i am about to finish my education in two months time and intended to go back to my country how long do i have to wait for that ,i am concerned.

And Many more might go off the list.some of them are big names in private college sector such as Holborn college,Guildhall college,LSBc, LCI and many more,so check your college before you apply for visa.Regards

If you wish to eradicate the “bad roat !! or the three partners making money and playing with students!!” of this bogus college you speak about( E********* school of business ), your best option I think would be to contact the local Citizen advise bureau for help and direction. You could also get in touch with a solicitor and file a case in the local court. It would also be possible to file a police complaint against the college “trio”.

Her visa will expire on May 2010.How can she apply for an extension or preferably apply for a work permit.The university gave them options.First, to enroll again on an NVQ course,but they will only be given an extension and second to find an employer that can sponsor them on a work permit. Based on my school (Anglia Ruskin Unversity) that as soon my visa expires I need to return to my home country and complete the remainder of my studies via distance learning. The end date of my course is on January 2011. Am I allowed to extend my visa? Is there other way than going home…because if I completed my degree, I am able to apply for Post Study Work…can I apply here before my visa expires?

Can one opt for a Diploma program(1 yr) and get a Visa or is a degree course essential?

In that time the college had their tier 4 sponsor and they’re quite well known as a good education provider. But last 2 or 3 weeks ago the UKBA has hold their licence.But I applied in December and I also had the biometric done after all of these they lost their licence and I’m the victim. It can take schools and colleges anywhere from 3-6 weeks to several months to be inspected by the UK Border Agency, for a Sponsor Action Plan to be drafted if needed and to be re-included on the Register. You should keep checking the master list of colleges on the tier 4 sponsors register.
Only the college and the UKBA will know for sure. After inspection, 32 days is set aside for correspondence, so it isn`t a quick process.

Hi. I hope you can help me with my problem. I’d been promised back in the Philippines that I can live with my relatives here in Stoke on Trent by my school and that I can have my classes here in Birmingham. But when I arrived, they told me that I have to take my classes in London which is really far from the place I am being accomodated with. When I asked them if I could transfer school, they told me I can, as long as I’m going to pay the whole amount of the tuition fee aside from the initial payment I already made which is £1500 . Should it be really like that? How come that I still have to pay the whole amount when I am not even going to study in their school anymore? Please help me. thanks!
