Government’s response to immigration appeals consultation signals end of AIT
The UK Border Agency have issued the Government’s response to the consultation “Immigration appeals, fair decisions; faster justice”, published in August last year, signalling the end of the AIT and High Court reviews.
Borders and Immigration Minister Phil Woolas said that he had taken the comments of the working group, including Lin Homer, Chief Executive of the UK Border Agency and Lord Justice Richards, Court of Appeal Judge, “on board”.
The Government intends to transfer appeals from the Asylum and Immigration Tribunal (AIT) to the First Tier and Upper Tribunal to “ensure that the system is fairer and faster, and that its decisions are respected and final”, said Mr Woolas.
The High Court review stage will be replaced by an appeal to the Upper Tribunal.
Mr Woolas said that the “Government expects the new system will ensure that 90% of asylum applications will have either been granted of have exhausted their appeal rights within 18 weeks”. Under the current system this process can take up to 42 weeks.

Appeals have already been abolished for student visa refusals. Students refused entry clearance under Tier 4 of the points based system, which took effect on 31 March 2009, will now have their cases reviewed by an Entry Clearance Manager (ECM) under the new Administrative Review system.

SPOUSE VISA & DEPENDENT VISA REFUSED TODAY !!!. What an arregant lot, MOSCOW VISA OFFICE. Refusal letter stated that although i am due £50,000 from inheritence money on 11/12/2010. and this was confirmed in writing by my solicitor, they want to see bank statement with money in the bank …my wife`s daughter refused due to needing, Afridvit from e-husband, THIS WAS GIVING !!! The idiots in visa office Moscow do not understand Russian Law. The ex-husband is a solicitor, he has giving permission for his daughter to leave the country (Russia) and live in the UK with her mother and me. And yes we suppiled 7kilos of paper/documents fully translated. Now i have an Immigration Lawyer (1,500+vat) to repply to ECO who refused. My lawyer is going to write direct to Moscow, cut all the red-tape of APPEAL and new application, although, even with answering the points he has refused on, it is not certain he will overturn his decision….How can they allow to keep us apart, it is inhuman, they are FACELESS, GUTLESS , PIGS….I wonder how Mr Cameron is feeling today having his WORLD CUP BID 2018, BEING REFUSED ? and he thought he had a water tight bid/application…….and how many millions of pounds wasted ?….no justice in this world.
