Extending your student visa

This post was written by Charles Kelly on October 30, 2008

Extending your student visa in the UK should be straightforward, but many discover that the process is not as simple as they think.

We receive hundreds of enquiries from students who want to extend their visas to complete their studies or start a new course. Many are refused by the Home Office for a variety of reasons.

If you are an international student on a student visa or with leave (permission to stay) to study in the UK, you can apply to extend your visa subject to meeting the immigration rules.

The UK Border Agency website advises that:

You must have last entered the UK with a valid student visa or prospective student entry clearance or visa

You must have been granted permission to enter or stay to re-sit an examination, or

as a student union sabbatical officer, as a as a work permit holder, under the Science and Engineering Graduates Scheme (now known as the International Graduates Scheme) or under the Fresh Talent: Working in Scotland Scheme or

you have valid leave (permission to stay) as a student.

If you attend a succession of short courses below degree level the maximum time you can stay in total as a student is two years. A short course is a course less than one year long or longer courses broken off before completion.

How to apply for a Student Visa Extension

In order to apply for an extension to stay in the UK to study you will need to complete an FLR(S) ‘Further Leave to Remain’ application form, which can be downloaded from the UK Border Agency website.

You must carefully study the guidance notes before completing and submitting the application form, otherwise you could be refused and lose your fee.

Why do Students get refused an extension?

In most cases, students are refused an extension of their leave to remain because they have failed to comply with the immigration rules. Common reasons include:

Working too many hours (yes, they can find out)

Not making satisfactory progress on the course (yes, they check attendance records)

Studying at a ‘non-approved’ educational establishment, which is not on the DIUS Register of Educational and Training Providers.

The first two reasons are quite clear, however, the last is less obvious. Many students arrive in the UK on a student visa for an approved college, but later find that the College or course is not what they thought it was or, as in the case of Affinity Training, the college has gone out of business. Students often feel pressured into rushing to signing up with a new provider or college and fail to check the DIUS Register.

You can search the register by visiting:

http://www.dcsf.gov.uk/providersregister/search.cfm

Transferring to another provider can be traumatic, but do not be pushed into making the wrong decision, as choosing the wrong college may result in your visa extension being refused.

Can I appeal against a refusal?

Yes, you can appeal to the Asylum and Immigration Tribunal (AIT), but you must have grounds of appeal and a valid case. If in doubt, take legal advice or see www.visaappeals.com for further information on the appeals process.

Finally, your stay in the UK on a student visa does not qualify you for permanent residency or Indefinite Leave, however, if you are legally in the UK for more than 10 years you may qualify for residence under the ‘long stay’ concession.

You can change courses, but take advice, as your visa extension is affected by a numbe of factors.

Check back with the Emabssy, as a visa (which you obtained for a course starting 2009) usually has a time limit upon which you should travel.

You are right to be concerned.

The UK Border Agency publishes a list of licensed colleges on its website:

Hi,
I have just finished my graduation. I am entitled to have 2yr PSW. But, I’ve decided to go back to my country to set up my own business and apply for PSW from there, if I still stick on the PSW stuff. My visa gonna expire with in couple of days and I don’t want to renew it. The question is, what’s buffer time to depart after the visa is expired, as I’ve not booked my travel yet but will do in a short. Just curious about the legal issues.

Thanks

What do the terms of your visa state? Does it mention any “buffer time”?

To all people here on a visa – you should comply with the terms of your visa (e.g. apply for an extension or leave before it EXPIRES). Otherwise you will be breaking the terms of your visa and be branded an over-stayer/illegal immigrant and you could be deported and/or banned from returning to the UK for up to 10 years.
This could also affect future applications to other countries.

The Home Office/UK BorderAgency are not interested in whether or not you were “in a mood” to study.

The immigration rules on student visas are clear. You must show satisfactory progress and attendance, otherwise your visa could be revoked.

My advice is that you should get back to study instead of sitting around whining!

My friend has been waiting as well for over 4 months now, he applied in Country for extension in Feb and is still waiting, biometric’s done in march, its really crazy!!

why are they taking soo long at HO, anyone?? is it caus they are too busy with back log of applications or isit caus they are doing further checks on certain cases………. its been 17weeks since the submission of application and 12.5weeks since the biometrics. and do most of people get their papers back within this time frame of 14 weeks or it can take longer than that and also has anyone got positive outcome after waiting for 14weeks or more ??

Hi,

I was wondering if anone can help me?
I am a South African and received my student visa in 2006 to start studying in September 2006. When I arrived in the UK I took a tour of the uni and was very unsatisfeid. I deferred my course until Feb 07 and used the time to look for a different uni. Unsuccesfuly I started studying at the original uni in Feb 06. My visa expires in Oct 2009 but I still have a semester left, I have passed all my subjects and have good grades. Will they refuse my visa extention because I did not study for the first 6 months of my visa?? Please help.

Hello Charles, what can someone do if their UK student visa has expired and they intend to extend their stay to complete an ongoing academic course?

#35
Written By Vince on July 3rd, 2009 @ 3:09 am

You should never allow any visa to expire while you are still in the country. You could be removed and banned from returning to the UK for up to 10 years under HC321http://www.immigrationmatters.co.uk/hc321-immigration-rule-change-to-start-soon.html The UKBA do not generally extend visas in country once they have expired, unless there are very good reasons or special circumstances.

#36
Written By Charles Kelly on July 3rd, 2009 @ 7:49 am

Thanks Charles for your response. Are you then saying it can still be possible to renew it. How about a situation where the visa expired while passport was lost or stolen. That sounds like a good reason, right? please tell me what you think about this.

hi, have a very complicated case,i started my course in jan 2007(mba) i also started doin a parallel course in IT in july 2007 which got over in july 2008 so since i had got a degree in IT i applied for psw on it in oct 2008 my student visa expired on nov 2008.i was rejected psw on the grounds that my college closed down and my passport returned on 31st jan2009 with a right to appeal.(i have read the rules of the HO which clearly states taht “if a college is closed by HO and any application recieved from that college after that date will be refused”but i got a degree in july2008 when it was valid i applied for psw in october2008 it was valid then as well.if they had refused and sent my application in december2008 i could have applied for student visa through my mba college under late application.i talked to my lawyers who are on the HO panel of immigration lawyers who said either appeal or go for extension of student visa as i am still studying full time for mba for and gave me a supporting letter explaining the case.so I appied for the extension and gave biomatric on 2nd april 2009,it will be 14 weeks on 10th july and i still havent recieved pp back.any advice.

I got my visa extended last year but shortly afterwards I got ill and I couldn’t attend my classes. Although I informed my school, they didn’t get the license this year so, I need to find another one. I have all the doctors letters (NHS) I might need, is it possible to apply for another course even without finishing the current one?

You should take advice from an OISC Level 3 registered immigration adviser who has experience in handling appeals. They will quote you their fees in advance.
Check the PISC website or check the IAS site.

Hello,
Please, I applied for MBA & ACCA programmes which commenced in February 2008. I’m through with the MBA but still awaiting the final result, with which I plan to apply for a post study visa, however, my visa expires by October 31st 2009, and I’m not sure if I will have my certificate by then to apply for the post-study visa. Also, I have to re-sit my last ACCA paper in December 2009, as a result of which I have to go back to the UK by mid-September since I’m in my home country as at now. Do you foresee any problems for me at the port of entry? Also, do you advise me to apply for extension of student visa immediately, or I should wait and hope to apply for the post-study visa when my MBA certificate is ready? Thanks.

Hi,

I am currently in the UK na d have just finished a masters degree at the Leeds University Business School. I shall get my dissertation results in October. However I am starting another masters this October at the Imperial College Business School, London. I havent had time to go back home to extend my visa owing to my tight schedule and my current visa expires in Jan 2010. When should i ideally make an application for the extension and what are the documents? I plan to use the student batch scheme in the Imperial College. Do let me know since I am really very paranoid about being refused.

Hello
i’m an international student. In 2008 I got 3 years visa to study in UK. Last year I did AAT level 2 which is a full time course. But this year I’m gonna do the AAT level 3 home study course which is not a full time course & it will take about six months. In march 2009 if I start ACCA full time, will it be possible to extend my visa in october 2010. That time I’ll be in middle part of ACCA.
Please let me know regarding this matter.

My visa expires in Jan 2010. exam falls in feb 2010. and also University has transferred my file to the Debt collecting agency to collect the fee balance. they are sending letter to home country threatening that this university fee debts will become a legal issue in the country of residence. what is this all about? how can i handle this problem? anyway I want to complete my course. for this anyway I’m gonna pay my fees. please advise

Hi,
I have to resit my masters examinations May 2010 & my visa expires 31st of January 2010. Due to the recent changes with visa applications in the border agency. My questions are as follows:

1.) My school is among 1 of the licensed educational providers so they are willing to give me a visa letter but due to the fact that the letter is going to state specifically that I am an out of attendance student. What are the chances that my extension application will be honoured?

2.) Also I have never broken any of the immigration rules, I stick to a part time work pattern of less than 20 hours in a week & have paid all my tuition fees in full. My school is saying the border agency said I should go back to my home country and apply from there that enclosing a visa letter does not guarantee extension of my stay. Is it possible for one to apply from inside UK instead of going out of UK & coming in again?

Why don’t you try and finish your BA and apply for an extension here in the UK? You should take advice before returning home, as after 10 years legally in the UK you might qualify for ILR under the long stay concession.

Hello! could you please advise me what to do in my situation.

I finished my masters course here in the uk and I am waiting for graduation. My visa was going to expire on the 31st of october 2009, but the uni asked the border agency to extend it. So I got an extension of my student visa: now it is a new page in my passport: “limited leave to remain” until the end of january. Now it turns out that I really need to visit my home country (Russia) to arrange some documents.

The question is: if I leave the UK now for 10 days, will I be allowed to come in (I mean back to tha UK)? As I want to attend my graduation, but my course ended already.

Thank you!!!

This coming March 2010, I want to go for vacation just for 10days to see my family which I have not seen since I arrived here in UK last Nov. 2009. My question is can I still comeback and pass through the immigration port when I comeback here in UK? Will they allow me to enter UK on April 2010 considering that my visa is near to expire already that is on August 2010? But afterwards I have still plan to renew my visa here. Thank you!

Hi. My student visa recently expired on the 31st Oct. I didn’t realise it and travelled to the UK on the 8th Nov. The immigration officer allowed me in and granted me 6 months of leave since I am a holder of a BNO passport. I would like to ask if I can renew my student visa during this time period. I saw on the UK border agency that I can apply as long as my visa doesn’t expire 1 month before the start of my course. I am currently doing A levels, which started at Sept. Please advice.

Hello I posted a question here today but cannot see it here.

here it is once again, i would really appreciate a response please.

Hello Charles,

Need to ask for your expertise and our situation is a bit complicated and will appreciate your expert advice. My wife is on a student visa and me and my daughter are her dependents which expired on the 30th of September 2009, we posted our extension information on the 24th of september however; a month later we got our application back stating that it was invalid and the payment information (which was the card details were incorrect). So on the 29 of October we send the same application form back with a cheque to the mentioned address with electronic copies of bank statement (signed as true copies by the bank) till the 22/10/2009(showing a saving accounts balance for upto £6700 for all 3 of us).

Upon lookin for advice on the internet and calling the home office they are saying that they havent recieved our forms yet and it might still be with the payment department but they say the following can happen depending on the case worker:

a) The form is old and we should have used the new form.
b) The bank statement might not cover for a months period as required.
c)As we have resend the second application after our visa expired, our application might be refused on grounds as overstayers.

Apart from this the other area of my concern is that the college my wife was regisetered with has been revoked of its tier 4 licence a month before our visa was due to expire, so she got enrolled with one that does have its licence but hasnt informed homeoffice as such. Will this cause a complication as well?

I hope that the information above is useful and if you need any further information from me please do not hesitate to email me.

Awaiting your response eagerly.

Hi Charles…I have questions about my sister which i sponsor to study here in UK.She arrived last September 2009 …the questions are as follows:

She actually came over through an agency which is not very helpful at all as we were all threathen throughout the extra days we asked for our sister to settle first before going straight to placement of work.My sister was just given the direction where to get the bus from Heathrow to Cumbria and up to where she’s to be picked up.
As a student, it was clearly stated that they should settle first in thier accomodation.Their accomodation is so filthy, full of dust and molds and actually all the bed and cupboards were unfunctional for their own use and comfort.
a. Is it alright for the student to look for their own University as the previous University she was enrolled with was not accredited to Register of Sponsors in Tier 4 (as I already checked)

b.Is it alright for the student to do the domestic job for the nursing home every weekend since there is no domestic hired and seems that it is not in their contract?

c.How long is the allowance they have to notify Home office for change of placement and university?

I do hope you can answer my querries and hope to hear from you soon. Thanks a lot

Hello,
Sorry to bother you, I know most of information are on the HO web site but there are 2 things I wasn’t able to find and therefore I am addressing you for a help.
I have recently obtained MA degree in London and my visa expires on 31st January 2010. I wanted to apply straight after obtaining a degree for post study visa but it happened that my balance dropped below 800 pounds only one day so I had to put money on savings again again to make sure it will stay there for 3 months safe. I will be sending my application on the 15th of January (before my leave expires, and when I will be having a proof that my funds haven’t dropped below 800 pounds for full three months e) but I am quite sure that HO will not be able to come up with a decision on my working visa in 2 weeks when my student visa will expire. I adviced solicitor who told me that according to the immigratio Law, as long as I send my application before my leave expires, I am entitled to stay in the country even after the leave expires at the condition that my passport is in the Home Office.
Could you knidly confirm that this is is the case? My second question is: am I entitled to work full time on student visa after I complete my studies and before my student visa expires? Please it is very important for me to know, as I would in that case look for additional job during Christmas holidays, but won’t look for it at all if that would mean that I would be working illegaly.

Look forward to your reply!!
Many thanks
Anna

I have been recently denied student Visa, on the grounds for non attendance and unsatisfactory progress. I agree with these facts. However, my reason for non attendance and unsatisfactory progress was due to poor teaching, lack of staff, and teaching quality. Due to which my result was poor and I felt I am just wasting my time. Thats why I had no option but to contact the accounting body and ask them for the list of all the college(I have email prove of that) that teaches the same course. I called each and every one of them and non of them apart from my college does it on full time basis. I came here to study and serve my dying country. But seeing that they is no hope in continuing the study i decided to look for another course. SOmething i have always been wanting to study, FILM MAKING. But by that time it was too late since no college or uni start any course in april. I looked for college whole summer and found Central Film School one of 3 best film school in London. There, with the staffs guidance they decided to put me on certificate course before doing Industry Filmmaking Diploma(starting march 2010). I have done Certificate course with flying results that they offered me bursaries of 12500 to study the diploma. They even offered me internship until march before i stat my diploma, so that i can gain experience and knowledge. I have switched from 1500 a year school fee to 19500 a year school which require me to be at school everyday 10 to 6 compare to my old school 2 days of 10 to 5, all because I want to study. That is my whole story. I have spoken with my solicters and they doesnt seems to know much. So i came to you. I have very limited time. I need to know chances of me getting the visa and if i feel you can help me.
So, please treat this as urgent and please help me

Hi,
I am expecting to complete my PhD soon. My student visa expiry also roughly coincides this. I am in dilemma about the time and place of post-study visa application after graduation:
1) If I apply after about 9-10 months of graduation from overseas/ home country I will not be staying in the UK continuously. Then does this discontinuity matter in the long run — there is a continuous 10 year stay option that allows to apply for citizenship etc. Will that be affected? Or will I jeopardize any future prospects?

2) How easy/ hard it is to get the post-study visa if the application is made outside the UK in a developing country? (I am studying at one of the top 5 universities in the UK)
Thank you very much

If anyone can help or give any advice I would be hugely grateful.

To put a very long & painful story short my girlfriend submitted a tier 4 student visa extension application on 20th July this year with all necessary correct documents included. It was returned a few days after her visa had expired saying that the photo was not found attached to the correct page. She was then told she could re-submit the application with the same documents and the initial submission date would be the basis of the application.
She then did so making sure to firmly attach her photo to the correct page. She then did a bio-metric test. On the 10th November after many postal problems she received a rejection letter on the grounds that her financial documents were invalid because they were not within a month of the application – This would not have been true if they had used the initial application date.

I have gone over the application and it appears that the home office mis-read the supporting financial documents. Becuase there were no transactions during a certain period in her bank the home office have read the document to be 2 weeks shorter than the it actually covered.
We then submitted a letter with further evidence backing this up. To which they replied saying that she is not entitled to a review or an appeal, but that she would be able to submit a new application.

Is this true? Can she submit a new even thought her visa is expired and she doesn’t have her passport.

Thanks to anyone who can clear this up.

Hi,

I am an International student since March 2008, in my first year I have passed my Adv Dip. Then I have extended for 1 year From May 2009 to May 2010 course i.e Professional Certification A+ CCNA & MCSE for which I got visa until Aug 2010. I have cleared my A+ but finding difficult to pass CCNA & MCSE though I had lot of practice now I realise that without studying Networking it is very difficult to pass CCNA & MCSE,. So I have decided to extend my visa by taking admission in Graduate in Networking thats 3 year. So my question is
1. When can i apply for this course after May 2010 or at the end of Visa Expire?
2. Am I eligible for the course as I want to study networking first and then this professional certification?
3. How much money I have to show and how many months bank statement I have to show?

Please let me know any more suggestion from your end.

Looking forward to hear from you.

Thanks

I am on student visa and about to finish ACCA- (Association of chartered certified accounts) and only one subject left to take in June.

At the same time, I am writing to submit the B.Sc Oxfords Brookes dissertation in April. My visa will be expired 28th Feb 2010. Do you think home office will allow me to finish my study although they don’t consider the dessertation is not their cocerned to give away the visa extension.
Do you think They can give me at least 6 months to finish my course?
It is kind of urgent.
Could you please kindly answer my question?

Sir,

I applied to renew my students visa in late October, 2009. I did the biometrics on December 1, 2009. It is 4th of February, 2010, and I am yet to hear from the Home Office.

The most intriguing aspect of my case is that, I have just found out that my College has been scrapped from the list of Education and Training Providers on the UKBA website. The College has not said anything to us yet. However, before I enrolled, the same college was rated A on the UKBA website. Even at the time I was applying for my visa renewal, it was still A-rated.

I have already paid a good sum of money to this college, covering my studies for a year.

I would like to know if my application will be refused on the grounds that my college ceases to be recognised by the Home Office. Additionally, it is almost too late for me to try and change a sponsor, as the application period for February entry to Universities and colleges has passed.
Please advise me on what step to take in these perplexing circumstances I find myself in.

I need to extend my visa for my final year (fourth year). How should I go about it? When should I apply for extension considering the september is my visa expire time? What financial documents would I need to show? Is having a funding very crucial? I am funded until sept, am applying for further funding, but am not sure if I would know about it before oct-nov. My country embassy requires my old passport for renewal of passport and also on;ly renew passport if it is less then one month due expire.

So what should be the solution? should I request uk-borders to return my passport so then I can renew and send them back.

Hi
I have been here from 2003, when i last review my visa, i was studying a east london university but i did not stay for long as i found it difficult to cope with the course. i stopped and change subjet and went on doing Nvq 4 and Lmc which i have already completed but without notifying the home office. As my visa is going to expired in december, but i want to carry on doing health management instead of Information & Technology course.I have enrolled with another college and the course is going to start in september10. Do i have to informed the Home office now or wait when my visa is going to expired. Also I want to travelled to go home in july. Will that affect me when i come back. Is this going to affect my visa when i will renew it next time.

HELLO Sir, my student visa extension has being refused in the Uk under tier 4 rules of not getting 10points for maintenance. I am still in the Uk and have right of appeal. Can i make another application without sending my appeal as i have the required funds but have to wait another 2 weeks to make 28 days. Is this alright, or would i have to go ahead with the appeal? Thanks

Hi there,
first thing you need to do is- submit your appeal in order to keep your right to stay in UK. And then once you ready for with your new bank statement then apply your new fresh application.
I saw lot of case like this i knew this from my experience, this is the best thing what you should do….

Thanks,

Hi,

I am doing PhD which was delayed and I took a gap year too. Now I am seven months away from completing the PhD. I made a mistake in providing the CAS number and wrongly provided the letter number. Visa was rejected after five months of applying and now, I am asked to return to India and apply from there. As only seven months are left, if I return now, the university will not give me extra time and I will not be able to complete the thesis. They have written that there is no appeal. Will you please let me know whether I can appeal on this decision? My travel documents are with the border agency. I think they return it only if I make travel arrangements.

This visa expires in three months time. What are my chances of extending the student visa, or applying for a work permit?.

Good afternoon!
I am currently a Canadian in the UK working on my postgraduate dissertation and would like to apply to the Tier 4 Visa that I am entitled to. I have a CAS number, sufficient funds, sponsor support, etc.

I would like to not have to return to Canada to apply for my Tier 4, but because I didn’t know that there was a special “Dissertation Entry Clearance”, I am just here as a visitor.

I therefore have a few questions: is there any way that I can apply for the dissertation entry clearance from the UK? Does one need to provide biometrics data for that? The reason I ask is because once I have that clearance, I could apply for the Tier 4 from within the UK. I wouldn’t mind going to the embassy/consulate in the Netherlands or something if it needs to be done out of country, but I don’t have the time to fly home to Canada.

Next, I have “enter to leave until September 30th” stamped in my passport because I didn’t know whether or not I would be readmitted onto my course (I left because my dad died) and confused the IO. Will this prohibit me from being entitled to a visa or entry clearance? Also I don’t actually know what “entry to leave until” means … Finally, my course doesn’t actually finish until October 8th.

Thank you so much for any clarification that you might provide.

Hello.I really need some urgent help. I applied for an extension of my student visa and it was refused. Later I appealed against the decision and my visa was allowed on 18.05.10.I have a court letter saying that I am not dealing anymore with visa issues and I just need to wait for the UKBA contact. The problem is I am waiting for my Foreign Identification Card for more than 13 weeks and it does not come.I called UKBA and they said that there is not time frame. No one gives me any information.I sent emails, special delivery letters and faxes and no answer. I know I cannot travel abroad without it but at least they could give me a letter where they state that I am allowed to work. I sent inumerous requests about that letter and no answer as well. I have been refused in lots of jobs. What do you suggest to me to do?I really need to work.
I am sorry for this extense report.
Thank you

4.My IELTS got expired on last month(june 2010).So do i need to write the exam again before extension?
5.I have worked some extra hours than the normal during my term breakes. Is it would be a problem while extending?

hi i am ashley, i came here in england as a student visa holder and i arrived on oct 19 2008, my first college was Kings College in Manchester near picadilly. and it was already under investigation for their license. I paid the Kings College 1500 and since they have licensce problem, I decided to look for another college,. however, the school didnt give me back the money.
Premier Inn College in Stockport was my second college. they promised me that before my visa expires on october 2009, they would have a license (it was only because they were new thats why they dont have the license yet- thats what they said). So paid them 2000 pounds, and again, they didnt have the license.

My third college was Global Vision College in Oxford Road and this one has a license. I renewed my visa. Half way of the semester, the college was again on investigation of the Home Office. and students were again needed to transfer. that was february 2010.

and since then, I didnt go to college anymore. coz the college will start on september. and since then i left my job as well in holiday inn manchester airport.

I’d like to know that after all what happened, can I still renew my visa and find another college again?

I feel so sick reading all these problems posted above. Im in the Philippines but I am also affected because my wife is in the same situation as yours. I feel so saddened that in a country like the UK, it is happening. I feel that it is really an abuse to any student. My wife left for UK with legitimate documents because it is the right thing to do. We do not want to break any rules in the UK but when she arrived in the UK, problems started to come out because of this TIER 4 issue. She left when TIER 4 was not in place yet but her school is investigated for the TIER 4 license and she was forced to transfer to CCC in London. All tuition fees has been paid in March but suddenly the school increased tuition fees in June and she was pressured to pay or she will be reported to UKBA and dismissed from the college. Can you imagine that? Isn’t that harrassment? My wife did not pay because she feels it’s a breach on their contract and the school does not have license yet. She sought advice from different agencies but until now, no action has been undertaken. If the Philippines is 3rd in the most corrupt countries, what do you call UK then? Nobody can help them with regard to this issue. They wrote to UKBA but no single reply was received from them. My wife now has no school, secondly she paid full tuition fees and she could not recovered the money even if this is a clear breach of contract. Her visa expires seven months from now and she did not have any course completed. When the time comes that she will extend her visa, for sure she will be refused because they will find out that she was not enrolled or completed any course within her stay there. But who’s fault is it really? I think personally, in the first instance, that she should not allowed to be bothered by the TIER 4 issue because she was still governed by rules placed before March 2009. But it seems that students arent well informed or misinformed by their sponsor schools. It is so surprising that even schools do not know how to advise students regarding this. How can you expect my wife to pay another tuition fee for a different college. You need to pay again 3000 pounds and how much is that in Philippine peso? 210,000 more or less. That is equivalent to two years of her pay here as a nurse. I could not help but be really mad at the way UK is treating their international students. Everyday is a trauma to us. We do not know what to do. No advisors to tell us the right thing and the right process. When we do research to UKBA site, some of the answers for relevant questions were deleted on their site pages. Come on! We may be from a 3rd world corrupt country but we are not idiots! We studied and we are professionals but you are treating us as if we were born just now. So disgusting!

You are not an idiot. Your wife’s motive is to work here and not to study. The level of education is higher from where you come from. You might be thinking that UK is the Fantasy Land, a pot of gold at the end of a rainbow. Rules are rules. For example, every company have its Equality and Diversity policies. Workers are treated fairly here, but not Asians. The blame might be on the color of your skin. Your efforts are not credited, no matter how skillful and industrious you may be. They can’t say, “This is My Land.” It is rude! They would rather say, “The law is hard, but it is Our law.” It is just rice crispies and cornflakes at the end of the rainbow. You are not an idiot, Mate, aren’t you?

my visa application has been refused because of I have not provided my Bachelor Diploma to Home Office.
Firstly, In spite of refusal decision Home Office gives me chance to make a new, fresh application. But there is a notice on 4th page of letter which is in all cases an application should be made before your current leave expires. Unfortunately, my visa expire date is 04.08.2010 they sent me the letter at 26.08.2010 and I have received the letter at 27.08.2010. They give me chance to make new application but my visa expire date has already passed today 25 days.
Secondly, regarding Home Office rules Tier 4 (Student) applicants have to keep £1.200 minimum 28 days in their bank account and show this amount on their bank statements. I have been keeping £1.200 in my account for 2 or 3 days.
I need to ask two questions.
The first of them is that shall I make a new and fresh application? Second one is that do I have to fill 28 days in order to send my fresh bank statement to Home Office?

But due to the failure in my Dissertation, I will have to re-submit it on 24th of September 2010 and my result will be published on November 2010.

My visa runs out in 2 weeks and I need an advice on what should I do if I want to stay in England up to the date when I due to resit those exams. Am I eligible to extend the duration of my visa on the grounds that I need to resit exams?
If not, are there any other options available for me?

Hello I posted a question here today but cannot see it here.

here it is once again, i would really appreciate a response please.

Hello Charles,
Need to ask for your expertise and our situation is a bit complicated and will appreciate your expert advice.

I am post graduate student and I apply for my visa extension under the Tier 4 General on July 2009. After long waiting period I received my passports with objection on 3rd of August 2010.The decision was not in my favour because as in previous extensions my uncle as bearing all my education and living expenses.
The reason of rejection was on 10 points of maintenance funds. Home Office gave me Right of appeal.
As per my consideration and understanding I received my documents in August 2010 and according to the decision I provide my own bank statement with amount of £8200
And my father’s six months (March2010 till august 2010) bank statements stating amount of 5, 00000 PKR which is more then £35000.
My appeal was again rejected and this time the judge said the bank statements have all sufficient amounts but does not cover 2009 when the application was lodged.

In my 2nd appeal I have submitted my father’s bank statement for the period of
January 2009 till March 2010 in respect of the Judge’s decision to prove my financial documents to cover the period of 2009. Why they are not considering my all documents which is already fulfil the immigration law’s requirements.

When Home Office didn’t send me back my documents in 2009 and there was not any clue that I have to provide 2009 bank statements and it’s not mention on the decision letter that we need financial documents for 2010 or 2009. If Home office would have send me documents in 2009 and requested in 2009 then I would have send 2009 bank statements which was back dated statements so could submit that time my father’s bank statement.

I don’t accept this First Tribunal decision. The decision is awful and disrespectful. According to the law and requirements I have fulfil all the requirements and send all my father’s bank statements since Jan 2009 till to day then why Judge is not considering my all documents despite of sending all the required documents.

If First Tribunal Judge can make mistake in my first appeal that Syed Rehan Raza Rizvi were born in Iran not in Pakistan which is a major mistake and can be count in racism. If I didn’t submit 2009 bank statements in 2010 off course you should have ask for back dated bank documents which is always available. This cannot be a major mistake as I have submitted later on.

I have already spent too much amount on my education, living and other expenses.
Please I want you to consider my application and allow me to study here as my all fees are up to date and I have fulfil all the requirements by the immigration law and requirements then there is no point to refuse it.
I have 2 questions.
1. Can i apply for new application under the Tier 4 suring my appeals?
2 Can i change my collage? because i think i should study with university now instead of any collages?
Please reply me asap.

hi, I’ve come to the UK on 3rd may 2010 and completed my International foundation year’10 course in business, law, and social studies area on last 10th December 2010. I’m waiting for my result now and it’s going to be published on 10th January 2011. My course was of more than 10 months in the University of Huddersfield ISC. Now I wish to switch to the main LLB course in London with a reputed institution. How should I apply now for extending my visa, because my visa will be expired on 12th February 2011. How much money/bank balance should I need to show for my living coast ? please clarify me. Thank you..

Hello,
I have got tier 4 student visa issued for a master’s degree and it expires by 21st january. I have finished the course and got my certificate. I have applied for a phd after completing the course, now I have got an unconditional offer and CAS number for PHd to extend my visa from an approved education provider. I was going to extend my visa in the UK but I had to go to my home country for a couple of days to sort out some important issues. Do I have to apply for tier 4 student visa here, in my home country, or is it OK to return to the UK and apply there? The thing is the phd course starts in 4th January, so I would prefer to extend it in the UK, but I am not sure if they would let me in with my current student visa since I finished masters.

However, my PhD final award will be announced in the third week of February, that is just a week before the student visa expires. Can I go ahead and still apply for a Post Study Visa? What will be my status after the exiry of the visa and durng the pendency of my application? Thanaks

As long as your visa has not expired and you are not doing anything illegal you should not have a problem.
Have you applied for an extension?

Hello good morning. My daughter is on a student visa in London since 2009. It expired May 2010 and was extended until April 13, 2011. Her studies will be finished this January 2011 at Anglia Ruskin University. I read that PSW visa will be abolished. I just what to know if those students who finished their studies this year will be affected by the abolition of PSW? Can my daughter apply for another extension? What are her options? Please help me.

I was on an MBA program – the final component of which is a research dissertation. The research was required to be done in India I am an Indian passport holder & in Delhi. Mystudent registration expires on 31stMarch 2011but my visa expires in February. The classes for the course are over. But my supervisor for the research is in UK & we correspond by email. However my degree is due in October 2011. For this the Examining board for my dissertation could even sit in July or later. In such circumstances do I need to extend my student visa or could I come to UK for the purpose on Tourist visa as well.

Dear Sir

I have applied for student VISA in Aug 2010 under Tier-4 General student category and my VISA application was successful. I have been received UK entry clearance from 25 Sep 2010. However, due to scholarship funding issues I couldn’t travel on that VISA and now all my relevant issues have been solved and i am intending to travel on dated 25-may 2011.

My Tier-4 General student VISA is valid until 31 January 2015 and my university (i-e; Queen Margaret University, Edinburgh) has deferred my starting date of my course (PhD Management Science) from 27 Sep 2010 to 27 May 2011. My question is that,

Can i travel to UK on the same VISA or i have to apply for fresh VISA?

Hello,

I am organizing an english course for foreigners under visa tier 2 and tier 4. It finishes at the end of August and I was wandering if it’s not too late for students wanting to extend or get students visa tier 4 before the academic year starts at the end of Septemebr.

If some of my students will be processing their applications at the end of August, will they be ale to e.g. go back to their country and get/extend visa within 3 weeks? Or do it in the UK within this time? I don’t know how long it takes to get it. UKBA wesbite says it’s straightforward but it seems like students always have problems waiting for visas. So I just wanted to make sure if I should perhaps do the course in July. Thank you in advance for any replies.
Best wishes
Lou

I did a foundation course in a college associated with the same university ( but are different sponsors) and my student visa was under the college sponsorship. When i finished my foundation, i moved on to my degree course with the university.
The issue here is that I have to renew my visa as my old one expired and the university has already given me the CAS letter. The only problem arising now is that when I switched from the foundation to university degree, I did not send a mail to the UKBA to inform them that i have swiched.
Does that affect my visa renewal in any way? Will they pick up that i did not inform them that i was switching from one sponsor to another?

Thanks

Hello

I have a friend who allegations of assault was made against. This was the second time by the same victim. The first time it was reported as a non crime and the second time a statement was made by the victim but later retracted. However, my friend’s student visa expired on the 31st of May, so after he was arrested for questioning for the allegations of assault and released on that count, he was re arrested immediately for the immigration issue….

His visa has expired for 10 days now, he still has resit exams and a project he has to complete at uni. They have had him in custody for almost 24 hours now and when he was allowed to call, he said he wanted his passport and it should be brought down to the station.

Do you think he could be deported? or does he have any chance of being asked to remain and immediately apply for an extension of his visa? What is the way out?

•restrict work entitlements, by only allowing students sponsored by higher education institutions (HEIs) and publicly funded further education colleges to work part-time during term time and full-time during vacations;
•restrict sponsorship of dependants to those of students sponsored by HEIs on postgraduate courses lasting 12 months or longer, and of government-sponsored students on courses lasting longer than 6 months;
•require institutions to confirm that courses represent genuine academic progression from any previous courses studied by the student in the UK; and
•create a streamlined application process for low-risk nationals sponsored by Highly Trusted sponsors.

Hi, My daughter’s student’s visa expires on 30.9.2011 (this coming Friday). She has to submit her MA thesis on this very day, and did get the promised help (with renewing her visa) from the university authorities. She is a US citizen. Can she leave the UK on Friday night (when her visa expires) and come back for a few days just to arrange her room and stuff, and then apply for extension of her student visa if she is accepted for PHd dtudies? What must she do? she is totally busy now with finishing her thesis. Many thanks for your urgent response.Ruth

I am starting MSC in October 2011 and once completed i would have been 9 years in the country having studied for 7 yrs and used 2 yrs post study visa. I understand you need to be in UK legally for 10 yrs. However, i am confused on what to do to get additional 1 yr to qualify. I will appreciate any form of advise so i can plan ahead.

If you are in UK as a student for the consecutive 10 years then you would be able to apply for ILR. The time period of Post study work visa would not be counted because on that time you would not a student.

#367
Written By Gsingh on October 15th, 2011 @ 6:00 pm

If you have 10 years of legal stay you can apply for ILR under the ‘long stay rule concession’ (14 years if in the UK illegally). Take advice, as ILR is not automatic or given easily.

Hi, I applied for a change of course and uni, after progressively studying for the Acca course in August 2010. I was refused by the home office, duet lack of enough funds. I went on with my masters programme, while the appeal went on and after 1 Year of going to court, I was finally granted a limited leave to remain, for just
1 month, ending 2 wks after submitting my dissertation. In the end , I could not submit dissertation, because I lost a relation, however, I went back to my country the day the visa expired. Now I wish to apply to come back to finish my dissertation, the uni has promised to issue a letter if the school approves my extension.
Please, I need to know what my chances are of getting an extension
to complete the dissertation. If the dissertation is submitted in January and I wish t apply in november from my country, do I need to show only 2 months maintenance? Thanks very much.

Dear Mr Kelly,

I submitted my MBA dissertation in September 2011 in a College affiliated to a University. The University Exam board was meant to sit in November 2011 and my VISA expires December 4, 2011. I am hoping to apply for PSW Visa. However, the University has changed its date and will instead sit on the last week of February, 2012. This means i do not have results for my MBA with which to apply for a PSW Visa. I had not planned on going home as I had not forseen the change of Exam Sitting board and was caught off guard. Please advice me on what options i have to extend my VISA than going back home.

My MBA course was exactly one year 4th October 2010 to 4 October 2011. Yet the home office gave me a VISA for 12 months and an additional 2 months instead of the required 4 months extra to await results.

Please advice, what is the best possible reason to use to apply to home office. I am totally stranded and would really appreciate your advice

You need to take advice. If you are not studying on a student visa you should go home. You may be able to switch to a dependant visa.

Hi everyone

I would like to know what happens if visa expired while passport was lost ? My visa is running out in 2 weeks an I have lost my passport , I am still student an did let UKBA know about the it , and have reporte to Police …. but getting a new one would take at least 2 month here in UK for me so I would overstay my visa for almost 2 month , would this be illegal ? would it have effect on ILR ? I appriciate if you could help me out with this.

I wish to extend my visa after my return. Is that a good idea? Will I be refused entry to UK due to the shord time of my visa?

I am on the tier 4 student visa. my current visa will expire in Aug 2012. However, my job offers contract from March-Oct 2012, can I have my current visa extend till Oct?
Since the PSW visa is going to be abolished in Apr 2012, I am afraid that I cannot get the qualification certificate before Apr. Or can I pre-apply the PSW?

I hold another ordinal bachelor degree qualification certificate from 2010. Or can I apply with this now?

You can still apply under Tier 2 provided you can find an employer and a qualifying position. You should see an adviser re PSW
