BIA consider 'out of time' Leave to Remain
applications for Senior Carers with expired visas

In an announcement yesterday, the Border and Immigration Agency (BIA) has clarified transitional measures for senior care workers who were “unable to extend their permission to stay in the United Kingdom within the normal time limit”.

In other words, those Senior Carers whose visas have expired.

The statement continues:

“Our staff will continue to use their discretion when deciding applications made within six months of the end of existing leave to remain”.

The BIA advises that applicants whose work permits have already expired should apply for extensions as soon as possible.

They go on to say:

“We are aware that because of these transitional measures some applicants have been unable to apply for further leave to remain within the time limit. Our staff can use their discretion to consider applications made outside the time limit and will do this when an application has been submitted within six months of the person's previous leave running out.

What this means for you

If you are a Senior Carer whose visa has expired the BIA will consider an ‘out of time’ application for Further Leave to Remain up to six months after your visa has expired.

This is good news for Senior Carers who fell between the two transitional measures announce last August and this January, although hundreds of overseas workers have already been forced to leave the UK to avoid being branded as "overstayers" by Immigration Officers.
